Provider Agreement

Terms for service providers, tradespeople, freelancers and independent gig workers using TruLink

This Provider Agreement applies to any individual or business that creates a provider profile, responds to a customer request, offers services, or uses TruLink to find freelance, temporary or gig opportunities.

1. Relationship with TruLink

TruLink provides a marketplace and matching service. You are not an employee, worker, agent, franchisee or representative of TruLink merely because you use the platform. You control whether to accept an opportunity and, subject to the agreement with the customer/business partner and applicable law, how you perform the work.

Nothing prevents a business partner that engages you through TruLink from entering into a separate employment or other contractual relationship with you. Any such relationship is between you and that business partner, not TruLink, unless TruLink expressly agrees otherwise in writing.

2. Provider Eligibility and Information

  • Be at least 18 years old and legally entitled to provide the services you offer.
  • Provide truthful identity, contact, experience, qualification and service information.
  • Maintain any licences, permits, registrations, insurance, approvals or certifications required for your work.
  • Immediately update expired, suspended, revoked or materially changed credentials.
  • Use your own identity and do not allow another person to perform work under your profile without customer consent and, where applicable, TruLink approval.

3. Verification

TruLink may require or offer verification. You authorise TruLink and its service providers to review information and documents you submit and, where lawful and disclosed, to confirm selected information with issuing bodies, references, public sources or verification providers. You must not submit altered or fraudulent documents.

Verification is not a guarantee of competence, safety, financial standing, honesty or future conduct. You remain responsible for your representations and performance.

4. Service Standards

  • Communicate clearly about scope, price, availability, materials, exclusions and expected completion times.
  • Attend confirmed appointments or provide reasonable notice if a change is necessary.
  • Perform with reasonable care, skill and professionalism appropriate to the service.
  • Use suitable tools, equipment and protective measures and comply with lawful health and safety requirements.
  • Protect customer property, confidential information, keys, access codes and personal information.
  • Do not perform work beyond your legal competence or licensing level.
  • Provide receipts, invoices or written price confirmations where appropriate and required.

5. Pricing and Payment

Unless TruLink expressly offers an in-platform payment feature, you agree payment directly with the customer or business partner. You are responsible for clearly stating your prices, deposits, call-out charges, material costs, cancellation charges and payment terms before work begins.

You are responsible for taxes, National Insurance contributions, business registration, accounting, payroll obligations (if you employ others), and any other statutory obligations applicable to your activities.

6. Customer Property and Access

You may enter a customer's home, workplace or property only to the extent reasonably necessary for the agreed service. You must respect boundaries, avoid unnecessary access to private areas or information, and return keys/access devices promptly. You must not photograph or record inside private premises without permission except where reasonably necessary to document the work or a dispute.

7. Prohibited Provider Conduct

  • Fraud, theft, deception, intimidation, harassment, unlawful discrimination or violence.
  • Misrepresenting qualifications, licences, identity, insurance, experience, ratings, prices or availability.
  • Unsafe work practices or knowingly using defective/unsuitable materials.
  • Pressuring a customer to pay for work not agreed or using threats to collect disputed payment.
  • Soliciting or publishing sensitive customer information for unrelated purposes.
  • Review manipulation, including buying reviews, self-reviewing, reciprocal false reviews or conditioning a refund on removal of an honest review.
  • Using TruLink to facilitate unlawful services, regulated activities without required approval, or any activity prohibited by TruLink policy.

8. Leads and Communications

TruLink does not guarantee a minimum number of leads, bookings, jobs or earnings. You must communicate professionally and must not spam users. Contact details obtained through TruLink may be used only for the relevant opportunity, legitimate follow-up, relationship management and lawful marketing where the recipient has consented or applicable law permits it.

9. Cancellations, Complaints and Rectification

If you cannot fulfil a commitment, notify the customer/business partner promptly. Where a complaint concerns defective or incomplete service, you should engage in good faith and, where appropriate, offer reasonable rectification, partial refund or other remedy. TruLink may request evidence and may restrict your account while serious complaints are investigated.

10. Reviews

Customers and business partners may review completed or genuine interactions. You may respond professionally but must not retaliate, threaten, harass or misuse personal information because of a review. Review challenges are governed by the Review/Complaint Policy.

11. Insurance and Risk

TruLink may recommend or require evidence of insurance for selected categories. Unless TruLink expressly states that insurance coverage is included, TruLink does not insure your work. You are responsible for assessing and obtaining appropriate public liability, professional, motor, workers' compensation/employers' liability or other coverage relevant to your activities.

12. Intellectual Property and Portfolio Content

You must have permission to use photos, logos, testimonials and portfolio materials displayed on your profile. You grant TruLink the licence described in the Terms of Use to display and promote your profile and submitted content.

13. Suspension or Removal

TruLink may suspend or remove a provider profile for fraud concerns, expired or false credentials, serious safety complaints, repeated unreliability, review manipulation, unlawful conduct, non-payment of TruLink fees, or material breach of this Agreement or the Provider Code of Conduct. TruLink may require corrective action or re-verification before reinstatement.

14. Responsibility for Your Services

You are responsible for your own acts and omissions, your personnel or subcontractors, the quality and legality of your work, materials you supply, and commitments you make to users. To the extent permitted by law, you will indemnify TruLink against third-party claims resulting from your services or breach of this Agreement, except to the extent caused by TruLink.

15. Other TruLink Terms

The Terms of Use, Privacy Policy, Verification Disclaimer, Review/Complaint Policy, Refund/Payment Policy and Provider Code of Conduct also apply and are incorporated into this Agreement. If a provider-specific provision conflicts with the general Terms of Use, this Provider Agreement controls for the provider-specific issue.

16. Governing Law

This Agreement is governed by the laws of Trinidad and Tobago. The dispute-resolution and general provisions in the Terms of Use apply.
