Business Partner Terms

Terms for organisations posting staffing, temporary-work, freelance or service opportunities

These Business Partner Terms apply to companies, institutions and other organisations that use TruLink to find service providers, freelancers, temporary workers, contractors or other talent.

1. Authority and Account

You confirm that you are authorised to act for the organisation named in the account and that business details, contact persons and opportunity information supplied to TruLink are accurate.

2. TruLink's Role

TruLink is a matching and marketplace platform. Unless a separate written service agreement states otherwise, TruLink is not the employer, employer of record, labour contractor, payroll provider or supervisor of individuals introduced through the platform and does not guarantee that a particular candidate will accept or complete an engagement.

3. Your Responsibility for Worker Classification and Compliance

You are responsible for determining the correct legal relationship with each person you engage. Depending on the engagement, this may include responsibilities relating to employment contracts, wages, overtime, leave, National Insurance, PAYE or other taxes, immigration/work authorisation, workplace safety, insurance, statutory records, termination rights and other mandatory obligations. You must not classify a person as an independent contractor merely to avoid legal obligations where the actual relationship is one of employment.

4. Opportunity Standards

  • State the nature of the work, location, duration, expected hours, required skills/credentials and compensation or compensation method clearly.
  • Do not post unlawful, misleading, discriminatory, exploitative or unsafe opportunities.
  • Do not require unpaid trial work beyond what is lawful and objectively reasonable for assessment.
  • Disclose material risks, required protective equipment, travel requirements, background checks or confidentiality requirements before engagement.
  • Do not request money from a candidate merely to apply for an ordinary job or gig unless a lawful, clearly disclosed third-party cost is genuinely necessary.

5. Candidate and Provider Information

Information obtained through TruLink may be used only for legitimate recruitment, contracting, vendor selection, workforce administration and related legal/compliance purposes. You must protect identification, contact, CV, credential and other personal information and must not sell or repurpose it for unrelated marketing without a valid basis.

6. Verification and Screening

TruLink verification is limited to the checks stated on the platform. You remain responsible for any job-specific background checks, references, medical/fitness requirements where lawful, licences, immigration status, right-to-work verification and other due diligence required for the role. Do not rely solely on a TruLink badge for regulated or safety-critical work.

7. Compensation and Payment

You are responsible for paying individuals/providers according to your agreement and applicable law. Unless TruLink expressly provides payroll or payment services under separate terms, you must pay them directly and maintain required records. You may not withhold undisputed payment as retaliation for a complaint or review.

8. Workplace Safety and Supervision

Where work is performed at your site or under your control, you are responsible for providing an appropriately safe environment, instructions, supervision where required, suitable equipment/PPE where applicable, and lawful working arrangements. Providers remain responsible for their own professional methods where engaged as independent businesses, but this does not remove your own statutory duties.

9. Non-Discrimination and Fair Treatment

Business partners must comply with applicable equality and labour laws and may not use TruLink to target, exclude or mistreat persons on an unlawful basis. Legitimate job requirements may be stated only where they are lawful and genuinely related to the role.

10. Complaints, Performance and Reviews

Address performance issues fairly and document material concerns. Reviews must be based on genuine interactions. Do not use reviews, references or platform reports to threaten, extort or retaliate against a person who raises a legitimate safety, payment or legal concern.

11. Fees and Commercial Plans

TruLink may offer free, subscription, featured-listing, verification or business plans. Any applicable platform fee will be disclosed before purchase. Unless expressly stated, TruLink fees are separate from compensation owed to providers/workers and do not replace payroll, agency, statutory or tax obligations.

12. Indemnity and Compliance

To the extent permitted by law, you will indemnify TruLink against third-party claims arising from your employment/engagement decisions, workplace, opportunity content, payment failures, unlawful discrimination, breach of data obligations or other violation of these terms, except to the extent caused by TruLink.

13. Suspension

TruLink may suspend or terminate a business account for fraudulent postings, unsafe practices, repeated non-payment complaints, discriminatory conduct, misuse of candidate information, impersonation, unlawful recruitment practices or material policy breaches.

14. Other TruLink Terms and Governing Law

The Terms of Use, Privacy Policy, Verification Disclaimer, Review/Complaint Policy and Refund/Payment Policy also apply. These Business Partner Terms are governed by the laws of Trinidad and Tobago.
